The International Plumbing Code, Edition of 2006, published by the International Code Council, is hereby incorporated by reference as though fully set out herein save and except such portions as are hereinafter deleted, modified or amended by this article. No fewer than three copies of the code shall be kept on file in the office of the city clerk for inspection and use of the public at all reasonable business hours. The file copies shall be marked or stamped “Official Copy as incorporated by the Code of the City of Marysville”. All sections or portions of the filed copies of the International Plumbing Code shall be clearly marked to show deletions, modifications or amendments thereto.

All references in the International Plumbing Code relating to natural and LP gas, piping and venting are hereby deleted.

No person shall engage in the business of plumbing, or of gas fitting in the city without first having obtained a license from the city. License will be issued on a calendar year basis, expiring December 31st of each year. For purposes of this article, plumbing and gas fitting is defined as follows:

(a)   Plumbing shall mean installing, altering, maintaining, or repairing plumbing, which shall include all materials and plumbing fixtures, water pipes, portable water treatment equipment traps, drainage and vent piping, and building drains, including their respective points, connections, devices, receptacles and appurtenances located within the property lines of any premises or in any building and the installing, maintaining, repairing, or servicing of lawn sprinkler systems, including without limitation replacing, repairing or testing of backflow prevention devices.

(b)   Gas fitting shall mean installing, altering, or repairing fuel gas piping, gas systems or fixtures and installing, repairing or testing of fire suppression systems.

Every person desiring to engage in the business of plumbing or gas fitting shall pay to the city an annual license fee of $250.00. Thereafter, an annual fee of $75.00 will be charged for each consecutive renewal of the license. Only one license fee shall be required paid, or bond and certificate of insurance given, for those doing both plumbing and gas fitting.

In addition to the license fee specified in 4-204 and before the plumbing and/or gas fitting license is issued, any person desiring such license shall file with the city clerk a good and sufficient bond in the amount of $10,000 with reliable corporate security by some company authorized to execute security bonds in the State of Kansas. The conditions of the bond shall be that the principal in the bond will save the city harmless from any and all damages to persons or property resulting from or in any way growing out of any opening or excavation made by the person, or his or her agent, servant or employee in any alley, street, highway, public property, sidewalk, curb, or in any connection with any plumbing or gas fitting work. The principal will restore all streets, avenues, alleys, sidewalks and curbing, to the condition in which he or she found them. The principal will indemnify and pay the city, or any person suffering loss or damage sustained from any unfaithful, imperfect or inadequate work done by the principal and that the principal will comply with all the ordinances of the city, in connection with any of the work. The bond will be issued on a calendar year basis.

Prior to a plumbing and gas fitters license being issued, every person must provide proof of liability insurance in the minimum amount of $300,000 by filing with the city clerk a certificate for same. Insurance shall be effective on a calendar year basis. However, only one bond and proof of liability insurance shall be required for those persons obtaining a license for both a plumbing and/or gas fitting license and an electrical license.

Any license issued under this article shall be issued upon the express condition that such license may be revoked by the mayor and city council for violation of any ordinance of the city relating to the work of plumbing and gas fitting or failure to provide bonding and liability insurance requirements as a condition of the license.

No license, bond or certificate of insurance shall be required if the plumbing and/or gas fitting work to be performed is accomplished:

(a)   By an individual upon property personally owned by him or her; or

(b)   By a firm or corporation, or one of its employees, on property owned or occupied by that firm or corporation.

Whenever the plumbing or gas inspector shall disapprove an application or refuse to grant a permit under this code or when it is claimed the provisions of the code do not apply or that the intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the plumbing or gas inspector to the governing body within 30 days from the date of the decision appealed.

The plumbing or gas inspector, or his duly authorized assistant, upon proper identification, shall have authority to enter any structure or premises at any reasonable hour in the performance of his or her duties.

The city water and sewer supervisor is hereby designated as the plumbing inspector for the enforcement of this article. The supervisor, with approval of the council, may designate the responsibility to make plumbing inspections to other qualified persons within his or her department.

It shall be the duty of every person who shall perform plumbing work covered by a permit to immediately notify the plumbing inspector upon completion of such work and before such plumbing has been concealed or covered in any manner whatsoever. The plumbing inspector shall inspect such work within 24 hours and, if it meets the plumbing code requirements, shall indicate his or her approval. No plumbing shall be enclosed or covered without the prior approval of the plumbing inspector.

Any person performing plumbing and/or gas fitting in the city without a license shall be guilty of a violation of this code, punishable by a fine not to exceed $499.00, with each day constituting a separate offense.
