For the purpose of applying this article, a commercial junk or salvage yard is defined to be any lot, land or structure, or part thereof, used primarily for the collecting, storage and sale of waste paper, rags, scrap metal or discarded material, or for the collecting, dismantling, storage and salvaging of machinery or vehicles not in running condition, and for the sale of parts thereof.

No junkyard shall be maintained in the corporate limits of the city unless located in a district so zoned and location approved by the board of zoning appeals.

It shall be unlawful for any person to maintain a junkyard within the city limits unless such business is carried on entirely inside a building(s) or the premises on which such business is carried on is entirely enclosed by a substantial fence at least six feet high to be approved by the building inspector. The fence must be maintained in a near-safe condition and shall be painted. Gates for access to the premises shall swing inwardly and such gates shall be kept closed when the premises are not open for business.

All premises used as a junkyard shall be kept and maintained in as clean, sanitary and neat condition as such business will reasonably permit. The person operating the junkyard shall maintain the premises so used so that rats, vermin and fire hazards are reduced to a minimum. No rubbish or portion or parts of wrecked machines and other accumulations which are to be discarded by such junk dealer shall be burned on such premises without the written consent of the chief of the fire department.

It shall be unlawful for any person to sell any item or items of junk to a junk dealer unless such person shall present to the junk dealer, at the time of sale, information as to the ownership of such item or items of junk. Such information shall include the name, address and place of business, if any. Every junk dealer shall keep a register in which the dealer shall at the time of purchase or receipt of any item, excepting rags and paper, enter the name, residence and place of business, if any, of the person from whom the junk dealer purchased or received the item, description of items purchased and the price for such item or items. All records kept in accordance with this article shall be open at all times to any police officer asking or demanding the same and shall permit such police officer to examine and inspect any such property as shall have been received.

No person or any agent, officer or employee of a junk yard shall purchase, take or receive any article or property from a minor unless such minor be accompanied by his or her legal or natural guardian or have written permission.

It shall be the duty of the building inspector and the Chief of the Fire Department to inspect or cause to be inspected, at least once every four months all junkyards in the city. Such inspections shall be for the purpose of seeing that such premises are operated in conformity with this article and are kept in a safe, sanitary condition.
