Amusement devices or machines are hereby defined as all coin-operated devices intended for amusement purposes, including but not limited to devices commonly known as music machines, juke boxes, pool tables, video machines and pinball machines. Weighing machines and vending machines intended solely for the sale of merchandise at its fair market value are excluded.

(a)   A separate license shall be issued for each amusement device. The license shall be issued to a specific person, firm, association, partnership or corporation for a specified location. If the licensed machine is removed from the specified location during the calendar year, a replacement machine may be substituted; however, any additional machines brought onto the premises which exceed the total number of coin-operated amusement device licenses issued for the specific location will require a separate license.

(b)   The license fee shall be $25.00 for each coin-operated amusement device and shall be for a calendar year ending on December 31st.

No license shall be issued:

(a)   To an operator who is less than 21 years of age;

(b)   Unless the premises housing the coin-operated amusement devices comply with applicable city ordinances and state statutes and regulations including but not limited to building, zoning, fire, health, safety and sanitation codes;

(c)   Unless the premises provide for safe ingress and egress.

Based upon the favorable recommendation of the city inspector and provided applicant meets criteria as listed in 5-203 above, the city clerk shall issue a coin-operated amusement device license upon payment of the license tax. All such licenses shall contain the name of the licensee, the name and address of the premises, the date license is issued; a brief description of the amusement device and the expiration date of the license. Such license shall be prominently displayed in the business establishment in proximity of the amusement device or devices.

Any license issued under this article may be revoked by the governing body of the city at any time on proof satisfactory to them that the owner, licensee, lessee or operator of any such coin-operated amusement devices has violated or permitted the violation of any of the provisions of this article.

It shall be unlawful for any licensee or for any person operating, maintaining or keeping any coin-operated amusement device, or for any owner, agent or employee in the place of business where any such coin-operated amusement device is kept, maintained or operated to use any such coin-operated amusement device as a gambling device or for gambling purposes.
