The International Fuel Gas Code, Edition of 2005, as recommended by the International Code Council, is hereby incorporated by reference and made a part of this article as though fully set out therein, save and except such portions as are hereinafter deleted, modified or amended by this article. No fewer than three copies of the International Fuel Gas Code shall be on file in the office of the city clerk for inspection by and use of the public at all reasonable business hours. The filed copies shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Marysville”. All sections or portions of the filed copies of the International Fuel Gas Code shall be clearly marked to show deletions, modifications or amendments thereto.

The city inspector shall assume the duties of the gas inspector and shall have primary responsibility for the enforcement of the provisions of this article.

It shall be the duty of any party installing or altering gas piping in any building in the city to notify the gas inspector when the work is ready for inspection. The whole system of gas piping shall be properly arranged for the gas inspector to test the same.

Where the requirements of this article have not been complied with, the gas inspector shall at once notify the owner or agent of the building in which work has been done and the party installing such work and shall order such defects as found to be changed, rearranged or removed within a reasonable time.

If, upon inspection and test, the installation of any gas piping or any part thereof shall be found to not comply with the requirements of this article, the same shall be changed, rearranged, repaired or removed within five days, and gas shall not be permitted to flow through any piping until the same has been inspected and approved by the gas inspector.

The gas inspector shall have the authority to cause the turning off of gas from the mains by giving the manager of any gas company written request therefore, and shall have the authority to such method to close the valve and shut off the supply in case of emergency where the flow of gas is dangerous to life and property, or may interfere with the work of the fire department.

No building shall be piped or fitted for gas nor shall any extensions over twelve (12) feet in length be made in any piping unless a permit shall be granted therefore by the gas inspector. No piping or fitting shall be covered or concealed from view until inspected and approved by the gas inspector. Any person desiring to perform any work relating to piping or fitting a building for gas or extensions in piping for gas shall file an application therefore at the office of the city clerk, giving the correct location, name and address of the owner of such building, and a full and complete statement of the proposed work.

The gas inspector shall keep a record of all inspections of gas piping made by him or her, and when the gas piping in any building, after inspection, is found to comply with the requirements of this article, he or she shall issue to the party doing the work a certificate of satisfactory inspection.

An inspection by the gas inspector and a gas inspection permit shall be required for the following:

(a)   Any new construction or major remodeling, or structure relocation, of any residential, commercial or industrial structures; or

(b)   If gas has been turned off in a structure for 12 months or longer.

To obtain a permit, the applicant must file an application with the city clerk, together with such plans and other information as required by the gas inspector. For each inspection by the gas inspector, a fee, as established by the city council, shall be charged and the fee made payable to the city.

The company furnishing gas shall have the right at all times to discontinue the supply thereof to any consumer who fails to pay the bills for gas and gas service as provided for by ordinance granting a franchise to such company and in conformance with KCC regulations.

No person, including the gas inspector, shall open any valve releasing gas from the mains of the supply company and no such opening or release shall be made by any person other than the manager of the supplying company or his or her representative, duly authorized in writing.

This article shall not be construed to relieve from or lessen the responsibility of any party owning, operating, controlling or installing any gas main, service pipes, distribution pipes, connections or gas fixtures for damage to persons or property caused by any defect therein nor shall the city be held as assuming any liability by reason of the inspection authorized herein.
