Article 1. Police Department

The police department of this city shall consist of the chief of police and such number of regular law enforcement personnel as deemed necessary by the governing body.

It shall be the general duty of the chief of police and all sworn law enforcement personnel to the best of their ability to preserve good order, peace and quiet throughout the city as provided by law or ordinance.

The chief of police and all sworn law enforcement personnel shall at all times have power to make arrest under proper process or without process on view of any offense against the laws of the State of Kansas or laws of the city and to keep all persons so arrested, unless admitted to bail, in the city jail, county jail or other proper place to prevent their escape until their trial can be had before the proper officer.

All persons arrested for violation of any law of the state and who shall not be charged with an offense under any law of the city shall be released to the custody of the sheriff of the county and such arrest shall be reported to the county attorney.

The chief of police shall have power to make such rules and regulations as may be necessary for the proper and efficient conduct of the department. Such rules and regulations shall be approved by the governing body or if there is a committee designated the oversee the police department, that committee shall have the authority to review and approve such rules and regulations.

(a)   Police Officers are employees who are empowered by ordinance to enforce laws designed to maintain peace and order, protect life and property, and to prevent and detect crimes; who have the power to arrest; and who have undergone training in law enforcement.

(b)   For Police Officers except for the Chief of Police, all hours worked up to eighty-six (86) hours during a 14-day work period shall be compensated at the straight or normal time rate. Hours worked in excess of eighty-six (86) hours shall be compensated in accordance with the requirements of the Fair Labor Standards Act (FLSA). Meal periods for Police Officers except for the Chief of Police shall be compensated and shall be included in the eighty-six (86) hours work period.

(c)   Time not worked but compensated, such as sick-leave, holiday, vacation, etc., shall be calculated as set forth in the Personnel Policy and Guidelines for the City of Marysville as it pertains to Police Officers.

(d)   Police Officers must obtain prior supervisory approval of overtime except when responding to a subpoena arising from police duties; when necessary to complete a preliminary investigation; to continue processing a traffic accident; to complete an essential phase of an investigation when deferment would adversely affect the case; when the assignment involves the safety of persons or property or when working any other authorized assignment.

(e)   Nine-hour work shifts resulting in 86 hours of straight or normal time plus 4 hours overtime during a two-week period is authorized for current Police Officers. For new Police Officers (those officers hired after the effective date of Ordinance No. 1814), the work period, including overtime, and compensation for hours not worked, as approved by this section, can be re-examined and modified by the City Council for general application prospectively. Any modifications shall comply with FLSA and any amendments thereto.
